The legal architecture that made the judgment possible was constructed over a decade. The 2015 Urgenda ruling established that the Dutch state had a duty of care to protect its citizens from climate harm. The 2021 Shell ruling established that corporations shared an equivalent duty. The 2025 damages judgment is the enforcement mechanism that neither ruling alone provided: a quantified financial consequence for a specific corporation's contribution to a documented harm.

The court accepted a damages methodology developed by economists at Vrije Universiteit Amsterdam that attributed a proportionate share of the Netherlands' climate adaptation costs — coastal reinforcement, flood management infrastructure, and agricultural transition expenditure between 2010 and 2020 — to Shell's global emissions over the same period, using the company's published emissions data and an established carbon attribution model. Shell's attributable share was calculated at 2.9 billion euros.

Shell challenged both the causal methodology and the legal standing of the state to claim damages for diffuse public expenditure. The court rejected both arguments, holding that where a defendant's conduct has materially contributed to a harm requiring public expenditure, the state has standing to recover costs that would not otherwise have been incurred, applying principles analogous to those used in tobacco litigation recovery actions.

The ruling is under appeal, and Shell has indicated it will pursue the case to the Dutch Supreme Court. Legal observers in fourteen jurisdictions have already noted that the damages methodology is exportable, and at least three governments — including Germany and the Philippines — have indicated they are examining analogous proceedings against major emitters.

"We are not punishing Shell for making energy," said state attorney-general Reinhilde Wessing. "We are asking it to pay for the coast it has been slowly submerging."
