The platforms had always argued that their drivers, delivery workers, and service providers were independent contractors — entrepreneurs choosing when to work, bearing their own risk, running their own micro-businesses. The Supreme Court of India has examined that characterisation against economic reality and found it wanting in every material respect.

The judgment, authored by Chief Justice D. Y. Chandrachud in a five-judge constitutional bench, applies a multi-factor employment test examining economic dependence, algorithmic control, exclusivity, and the allocation of business risk. On all four dimensions, the court found that platform gig workers in India function as employees: they are economically dependent on the platform, their work is controlled by algorithmic dispatch and rating systems that function as managerial authority, they are practically precluded from working for competing platforms simultaneously, and the fundamental business risk is borne by the platform rather than the worker.

The immediate statutory consequence is entitlement to provident fund contributions — equivalent to 12 percent of earnings paid by the employer — paid sick leave, annual leave, and protection against arbitrary deactivation without due process equivalent to unfair dismissal protections. Platforms have 18 months to comply.

Industry estimates suggest compliance will add 18 to 23 percent to platform labour costs in India, a figure that analysts expect to be partially absorbed through fare increases and partially through efficiency improvements in algorithmic work allocation. Three platforms — Rapido, Porter, and Dunzo — have indicated they will restructure into cooperative models rather than comply with the employment framework.

"The app does not make you free," said Justice B. V. Nagarathna in a concurring opinion. "It makes you controllable without accountability. That is not independence."
