The 2007 Indian Residential Schools Settlement Agreement was, at the time, the largest class action settlement in Canadian history. It compensated approximately 80,000 surviving former students for the direct experience of attendance at institutions where physical and sexual abuse were systematic, and where the explicit policy was the destruction of Indigenous language, culture, and identity. What it did not address was what happened to the children of those survivors.

The Supreme Court's ruling, in a 6 to 3 decision, accepts the evidentiary record establishing that intergenerational trauma — transmitted through disrupted parenting, attachment disorders, substance dependence, and cultural disconnection — constitutes a foreseeable and documented harm causally linked to the government's operation of the residential school system. The majority holds that the 2007 settlement did not extinguish liability for harms experienced by persons who did not themselves attend residential schools.

The practical scope of the ruling is vast: Statistics Canada data suggest 200,000 to 400,000 living Canadians could potentially establish intergenerational harm claims meeting the evidentiary threshold the court has outlined. The federal government has 24 months to establish a claims assessment framework, which the court has directed must include Indigenous-designed evaluation processes and non-adversarial resolution pathways.

The dissenting justices argued that extending liability to indirect, intergenerational harm without a clear causal chain individualised to each claimant creates an indeterminate liability exposure inconsistent with settled tort principles. The majority responded that where a harm is both foreseeable and documented at a population level, the indeterminacy of individual causation cannot be a complete defence.

"Truth was established years ago," said Assembly of First Nations National Chief Cindy Woodhouse. "Today we moved one step closer to reconciliation having legal meaning."
