Canada's Free, Prior and Informed Consent Legislation Gives Indigenous Nations Binding Veto Over Resource Projects — and Sets Off a Constitutional Battle

The Canadian parliament has passed Bill C-71, implementing the UN Declaration on the Rights of Indigenous Peoples into domestic law with a binding consent requirement for resource extraction projects on or near traditional territories. Three provinces have announced they will challenge the law at the Supreme Court, arguing it creates an unconstitutional third order of government.
